TENDER NOTICE

Online digitally sealed (Two Envelope Bids) tenders are invited for Bicycle from Manufacturers & Authorized distributors only for fixing Annual Rate Contract for a period up to 30th June 2014 by the Development Commissioner (Ind .), & C.P.O. Mumbai. Directorate of Industries, New Administrative Building, 2nd floor, Opp.Mantralaya, Mumbai-400 032.on behalf of Governor of Maharashtra.

The Contractors participating first time for e-Tenders on Govt e-tendering portal will have to complete the Online Registration Process for the e-Tendering portal.

All bidders interested in participating in the on-line e-Tendering process are required to obtain Class II or Class III Digital Certificates. The tender should be prepared & submitted online using individual’s digital signature certificate.

The details such as specifications, terms and conditions of below individual items are incorporated in tender document & same should be downloaded from Government website https://industries.maharashtra.etenders.in from 30/09/2013 to 28/10/2013. Blank Tender documents will not be sold by this office; interested bidders have to download tender documents from the website. The tender document should be accompanied with Rs 2000/- D.D.to be drawn in favour of “Development Commissioner (Industries) & C P O Mumbai”. Payable at MUMBAI Only, and original demand draft should be submitted in the office of the the Development Commissioner

8D.G.S.& D. rate contract holder should furnish copies of D.G.S.& D.rate contract.

9(a) If the tenderer is an authorized distributer, he should furnish valid Distributorship Certificate in the format prescribed at Section-5 from the manufacturer. Xerox copy of Distribution Certificate should be attested with valid dates. (Original Distributorship Certificate should be submitted for verification whenever called for.)

Terms and Conditions

Section -4

N.B.: This Section 4 must be signed with seal and should be submitted with the tender in technical bid.

1Both the Bids (Technical as well as Commercial) shall have to be submitted online only. Bids not submitted online will not be entertained.

2Tender shall be fully in accordance with the requirements of the General Terms and Conditions. Appropriate forms furnished with this tender document shall be used for filling the tender. Incomplete, illegible and unsealed tender will be rejected. Telegraphic tender will not be accepted and no correspondence will be made in this matter.

3Conditional offers and offers qualified by such vague and indefinite expression such as

"Subject to immediate acceptance," " Subject to prior sale" etc. will not be considered.

4Submitted tender forms, with overwritten or erased or illegible rate or rates not shown in figures and words will be liable for rejection., Clerical and arithmetical mistakes will not be entertained, such tenders will be rejected.

5Request from the tender in respect of additions, alterations, modifications, corrections etc. of either terms and conditions or rates after opening of the tender will not be considered.

6Any attempt by any bidder to bring pressure of any kind may disqualify the bidder for the present tender and the bidder may be liable to be debarred from bidding for the Development Commissioner (Industries ) & C.P.O., Mumbai in future for the period of three years.

7Disqualification or rejection of Tenders.

The tender is liable to be rejected or the bidder disqualified at any stage on account of the following.

a)If the bid is received by Telex/Telegram/Facsimile (Fax) /email/ in Person

b)If the bid or its submission is not in conformity with the instruction mentioned here in.

c)If the bid is not accompanied by the requisite EMD.

d)If the tender is incomplete and the required documents as specified in the tender document are not furnished.

e)If misleading or false statements/representations are made as part of pre- qualification requirements.

f)If found to have a record of poor performance such as having abandoned work, having been black-listed, having inordinately delayed completion and last years orders not full filled well in time, mass complaints received from various government department.

9Payment Conditions: 90% payment within 2 weeks from the date of receipt of stores in good condition and balance 10% within 30 days from the date of receipt of all stores in satisfactory condition as ordered.

10Delivery Period Six weeks from the date of confirmed order.

11Warrantee: - One year from the date of receipt of store goods. (Fully assembled bicycle).

12Inspection: - By the consignee or any agency appointed by Indentor at consignee place.

13The Tenderer should submit its quoted models for demonstration for technical evaluation whenever called for by the C.S.P.O.

14Furnish the acceptance about the tender conditions VIZ. Penalty Clause, Risk Purchase Clause, Fall clause etc.

15The tenderer should read carefully the terms & conditions stipulated in price tender form as well as General Terms and Conditions enclosed along with the tender form and introductory page of " MAHARASHTRA GOVERNMENT GAZETTE, PART- II" (Supplementary)

16In case the tender is required to be extended due to insufficient response or for any other valid reason, the details of extension of tender may or may not be published in the " MAHARASHTRA GOVERNMENT GAZETTE, PART-II" (Supplementary). It would be available on web site.

17The successful tenderer should submit monthly statement of order executed with the various Government department under this rate contract to this office by 10th of every month without fail. If the successful tenderer fails to submit this report he will be liable for penalty to forfeit security deposit.

18The Tenderer should furnish security deposit of Rs.2,00,000/-(Two lacs only) if R/C is awarded.

19The Tender Document is not transferable. Only the party who has purchased this tender form shall be entitled to quote

20The Tenderer shall bear all costs associated with the preparation and submission of its Tender document .

21The tenderer must submit an undertaking on his letterhead that he or his close relative or the company/ Enterprises floated by them in same or different names has not been black listed by any state /any Department or Central Government.

22Only the courts situated in Mumbai shall have jurisdiction in case of all legal proceedings.

23If any tenderer wishes to lodge any complaint against the other tenderer regarding submission of false documents, information etc. the tenderer has to deposit Rs.50,000/- (Rupees Fifty Thousand Only) in form of Demand Draft in favour of Development Commissioner (Industries) and C.P.O. Mumbai, alongwith the complaint letter otherwise will not be entertained.

The amount so deposited shall be refunded it after scrutiny the complaint found to be true. However, if the complaint found to be false and malafide, the deposit will be forfeited.

24After the technical evaluation, successful tenders will be considered for commercial bid

opening.. The decision of the evaluation committee in the evaluation of the technical and commercial bids shall be final. No correspondence will be entertained outside the process.

25The tenderer has to submit all the pages of tender document duly signed by authorised signatory

26No individual or the firm should have direct interest into the other firm participating in the tender. Such an direct interest shall be considered as conflict of interest, resulting in rejection of both or more such bids. For example, an individual who is proprietor / director / partner / majority stakeholder of company X shouldn’t be the proprietor / director / partner / majority stakeholder of company Y, in case both X & Y are bidding for the same project.

In case all the bids received have proprietor / director / partner / majority stake holders from the same family or the same blood relation, then such a tender shall be termed as non- competitive.

The authority to decide in the above matter would rest with the Development Commissioner (Industries) & his decision will be final.

27In order to have the option to the purchasing departments to purchase stores at lowest possible rates from more than one vendor, the tenderer who has quoted lowest rate in any of the slab mentioned in commercial tender form (Price Schedule) will be eligible to accept L-1 rates in other slabs also. Similarly, tenderers quoting L-1 rates in all the other individual slabs may also consider eligible to accept rate contracts at L-1 rates for other slabs.

28A pre-bid Conference of all probable tenderers will be organized on the date mentioned in the time schedule of the Tender Enquiry. All such probable tenderers can attend the pre-bid Conference. They may submit their suggestions, if any, regarding the tender enquiry in the pre-bid conference. However, all rights are reserved with Tendering Authority to accept or reject their suggestions.

29The Development Commissioner (Inds) and C.P.O., Mumbai, Directorate of Industries reserve the right to accept any Bid, and to annul the bid process and reject all Bid at any time prior to awarded of contract with out assigning reason and without there by incurring any liability to the affected bidder or any obligation , to inform the affected bidder of the ground for the purchasers action.

Instruction to bidders for online submission

The interested contractors / bidders will have to make online payment (using credit card/debit card/net banking/Cash Card) of Rs. 1038/- (inclusive of all taxes) per bid per tender to online service provider of e-Tendering system (Sify NexTenders) at the time of entering online Bid Submission stage of the tender schedule.

The date and time for online submission of envelopes shall strictly apply in all cases. The tenderers should ensure that their tender is prepared online before the expiry of the scheduled date and time and then submitted online before the expiry of the scheduled date and time. Offers not submitted online will not be entertained.

No delay on account of any cause will be entertained. Offers not submitted online will not be entertained.

If for any reason, any interested bidder fails to complete any of online stages during the complete tender cycle, department shall not be responsible for that and any grievance regarding that shall not be entertained.

OPENING OF TECHNICAL BIDS:

TECHNICAL ENVELOPE (T1):

First of all, Technical Envelope of the tenderer will be opened online by competent authority through e-Tendering procedure to verify its contents as per requirements. If the various documents contained in this envelope do not meet the requirements, a note will be recorded accordingly by the tender opening authority and the said tenderer’s Commercial Envelope will not be considered for further action but the same will be recorded. Decision of the tender opening authority shall be final in this regard.

COMMERCIAL ENVELOPE (C1):

This envelope shall be opened online by competent authority as per the date and time given in detailed tender schedule (if possible), through e-Tendering procedure only,

The financial bids shall not be opened till the completion of evaluation of technical bids. Commercial Bids of only technically qualified Bidders as mentioned above will be opened.
